These Terms apply to your access to and use of s90.com, operated by s90, LLC. If you are an s90 client, your client agreement governs the services s90 provides to you. These Terms govern the website and do not modify any signed agreement between you and s90.

Content on this site, including descriptions of laws, regulations, standards and frameworks, is provided for general informational purposes. It is not legal, compliance, insurance, accounting or financial advice and should not be relied on as a substitute for advice from your own qualified advisers.

Requirements vary with an organization's circumstances and change over time. s90 does not determine, certify or guarantee that an organization is compliant with any law, regulation, standard or framework unless a signed agreement expressly states otherwise. Your organization and its advisers are responsible for determining which requirements apply and whether they have been satisfied.

Website descriptions of s90 services, packages and Posture Reports are summaries for informational and marketing purposes. They do not create or modify an obligation to provide any particular service, deliverable, result or level of performance. The services and deliverables s90 provides to a client are determined by the applicable signed client agreement.

Any cyber warranty described on this site is a limited warranty made available through s90 and provided under a separate Customer Limited Warranty Agreement with the applicable Cork warranty provider. Eligibility, coverage, covered expenses, limits, exclusions, claim requirements and payments are governed by the applicable Customer Limited Warranty Agreement and Schedule A, which control over any summary on this site. The warranty is not insurance. s90 does not adjudicate warranty claims or guarantee payment of a claim. No warranty coverage is created or bound merely through use of this website.

Unless otherwise indicated, the site's text, design, graphics, logos and other content are owned by s90 or its licensors and are protected by applicable intellectual property laws. You may view public site content for lawful personal or internal business reference and may share links to public pages. You may not reproduce, modify, distribute, republish or commercially exploit site content without our written permission.

You may not use the site to violate applicable law, interfere with the operation or security of the site, attempt to gain unauthorized access to systems or information, introduce malicious code, or improperly collect information about other visitors.

The site may contain links to third-party websites or services for convenience or reference. s90 does not control those third parties and is not responsible for their content, availability, security or privacy practices.

The site and its content are provided on an "as is" and "as available" basis. We work to keep information accurate and the site available, but we do not warrant that site content is complete, current or error-free, or that access will be uninterrupted or secure. To the fullest extent permitted by law, s90 disclaims warranties relating to the site, whether express, implied or statutory. This disclaimer does not alter any express obligation in a signed client agreement or the cyber warranty agreement.

To the fullest extent permitted by law, s90 will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, or for loss of profits, revenue, data or business opportunities, arising from or relating to use of or inability to use the site.

To the fullest extent permitted by law, s90's aggregate liability arising from or relating to the site will not exceed $100. These limitations apply only to claims relating to the website and do not modify liability provisions in a signed client agreement or the cyber warranty agreement.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or use of the site that is properly brought in court will be subject to the exclusive jurisdiction and venue of the state courts located in Orange County, California, or the United States District Court for the Central District of California, as applicable.

We may update these Terms by posting a revised version on this page. Changes apply prospectively from the date the revised Terms are posted and do not modify any signed agreement between s90 and a client. Last updated October 1, 2026.
